Why did you choose JV Films Photography?!

(2) JV Films Photography Contract, Terms and Conditions:

PERFORMANCE OF SERVICE. It is understood that JV Films is the exclusive official photographer retained to perform the services stated on this Contract. JV Films will provide the services listed in a timely manner. PAYMENT. The client agrees to pay amount agreed upon by the event date. No part of any order, including previews, will be delivered until the balance is paid in full. The charges in this Contract are based on JV Film’s Standard Price List. This Price List is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed. DEPOSIT. At the time of signing the Contract, the client shall pay a non-refundable deposit of $0 to JV Films for the Services. The deposit will be subtracted from the total payment owed by the client upon completion of the Services. CANCELLATION POLICY. Upon signature, JV Films shall reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, all deposits are non-refundable, even if the date of the event is changed or the event is cancelled for any reason. Any cancellation made with less than 30 days notice prior to the agreed upon service date will result in full payment within 30 days of notice. If the cancellation is initiated by JV Films, all monies paid to JV Films from the client shall be fully refunded, including the deposit fee. Refund shall be paid out within 30 days of cancellation notice. TERM. The client and JV Films agree that this Contract shall commence on date signed and terminate upon receipt of stated services. Said Contract may be extended and/or renewed by agreement of all parties in writing thereafter. WORK PRODUCT OWNERSHIP. JV Films reserves the right to use videos and/or reproductions for advertising, display, publication or other purposes. Negatives, digital files, and previews remain the exclusive property of JV Films. NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photos without JV Film’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. UNACCEPTABLE QUALITY. Where services provided are not of an acceptable technical quality, making it unfit for the purpose of its specified use, then no fee or job-related costs are due to JV Films. JV Films has the right to rectify the defect causing the rejection within a reasonable time, having regard to the urgency of the work. If rectified, JV Films is entitled to their fee and service related expenses but may not charge the Client an extra fee or cost. Further, if JV Films produces services that are in the same style and structure as it’s past work, by reference of JV Film’s portfolio, the Client is deemed to have accepted JV Film’s artistic interpretation and are therefore not exempt from paying fees and job-related costs. FORCE MAJEURE. If JV Films cannot perform this Contract due to fire, or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to JV Film’s illness or emergency, then JV Films shall return the deposit to the client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that video materials are damaged in processing, lost through camera or other media malfunction, or otherwise lost or damaged without fault on the part of the videographer. In the event that JV Films fails to perform for any other reason, JV Films shall not be liable for any amount in excess of all monies paid. JV Films may substitute another photographer in the event of JV Film’s illness or emergency. In the event of such substitution, JV Films warrants that the photographer carrying out the services shall be a competent professional. COVID-19. In the case that services are cancelled due to the COVID-19 pandemic, all monies shall be returned to client. GOVERNING LAW. This Contract incorporates the entire understanding of the parties and is governed by the laws of Monroe County, NY. Any modifications of this Contract must be in writing and signed by both parties.
